DISPUTE RESOLUTION
Comprehensive dispute resolution through mediation and negotiations, and litigation/arbitration where necessary, is the main focus of Attorney-at-law Dima Alexandrova’s practice. Her understanding of dispute resolution is holistic and does not relate solely to conducting court proceedings, which is why she actively offers mediation and out-of-court dispute resolution services.
As a qualified attorney since 2016, Attorney Alexandrova has extensive practical experience in representing clients in court proceedings before various Bulgarian courts. She has represented leading local companies, as well as foreign companies, primarily from the United Kingdom. Attorney Alexandrova has specialized in international commercial arbitration and dispute resolution at King’s College London and has worked on litigation and arbitration matters alongside English barristers from Brick Court Chambers, London.
She frequently participates as a speaker at international alternative dispute resolution fora, where she exchanges experience and professional contacts with colleagues from different jurisdictions. Since 2016, she has also served as an arbitrator in the Willem C. Vis International Commercial Arbitration Moot.
Thanks to her comprehensive perspective on dispute resolution as both a lawyer and a mediator, Attorney Alexandrova offers her clients optimal solutions for the full and effective resolution of their disputes, taking into account time, cost, and the desired outcome.
If you have a dispute with a counterparty, you may contact Attorney Alexandrova for a preliminary assessment of your case. She will advise you on the most beneficial course of action moving forward – whether to initiate court proceedings immediately, whether to apply for interim measures (injunctive relief) and then commence proceedings, whether to attempt negotiations or mediation first, and only thereafter proceed to court.
As part of this preliminary assessment, checks are carried out in relation to your debtor, including verification of any outstanding obligations to the National Revenue Agency (which is a privileged creditor), checks with the Chamber of Private Enforcement Agents for any enforcement proceedings initiated against the debtor, and a review of the debtor’s assets. Based on this, an assessment is made as to the likelihood of successfully satisfying your claim in the event of a favourable court judgment.
Following the preliminary assessment, and upon Attorney Alexandrova’s recommendation and the client’s consent, steps may be taken towards voluntary out-of-court settlement of the dispute. If mediation and negotiation methods are exhausted, the matter may then proceed to court litigation or arbitration.
Arbitration, similarly to mediation, is an out-of-court method of dispute resolution. Arbitration is based on the consent of the parties – an arbitration agreement/arbitration clause in a contract is always required. Through such agreement, the parties assign the resolution of the dispute to an arbitral tribunal and exclude the jurisdiction of the state courts.
The advantages of arbitration include:
-A single-instance procedure and speed;
– The possibility to appoint arbitrators with substantial expertise in the relevant field;
– The arbitral award is final and constitutes an enforceable title;
– Confidentiality.
Arbitration is particularly suitable for commercial disputes. Even where an arbitration clause is not included in the contract, the parties may enter into a separate arbitration agreement after the dispute has arisen.
